Gardeners Croydon Terms and Conditions

These Terms and Conditions set out the basis on which Gardeners Croydon provides gardening and related outdoor maintenance services to residential and commercial customers. By requesting a quotation, making a booking, or allowing our team to carry out work, you agree to be bound by these terms. Please read them carefully before placing an order for any service.

1. About our services

Gardeners Croydon provides a range of gardening services, which may include lawn care, hedge trimming, pruning, planting, seasonal clearances, general garden maintenance, soft landscaping, and the removal of green waste where agreed. The exact scope of work will depend on the quotation, service description, and any site inspection or discussion before the work begins. Any work not expressly included in the agreed service will be treated as additional work and may be charged separately.

We aim to provide services across Croydon and surrounding areas, subject to scheduling and availability. Service area coverage may vary depending on the type of work required, access, timing, and team capacity. Acceptance of an enquiry does not guarantee availability until the booking has been confirmed.

2. Quotations and estimates

Any quotation or estimate provided is based on the information available at the time, including the size and condition of the garden, access arrangements, the nature of the work, and any special requirements you have told us about. If the actual site conditions differ from the information provided, we may revise the quotation before starting work or during the visit if additional time, labour, materials, or equipment are required.

Estimates are given in good faith, but they are not fixed prices unless we clearly state otherwise in writing. If a fixed price has been agreed, it applies only to the work described and assumes normal access and standard conditions. We reserve the right to charge for unforeseen extra work, waiting time caused by poor access or delayed access, or work requested after the booking has been confirmed.

3. Booking process

Bookings may be made by direct request through our usual booking channels. When you make an enquiry, you must provide accurate information about the property, the work required, access arrangements, parking, pets, hazards, and any known restrictions. You are responsible for ensuring that the details you provide are complete and correct.

A booking is not confirmed until we have accepted the job and communicated confirmation to you. Confirmation may include the agreed date or time window, the scope of work, the estimated or fixed price, and any special conditions. We may refuse or postpone a booking where the work is unsuitable, unsafe, outside our capacity, or subject to weather or other circumstances beyond our reasonable control.

You must ensure that someone authorised to approve the work is available if required. If access to the garden or property is not possible at the agreed time, we may charge a call-out fee, waiting time, or a cancellation fee where applicable.

4. Customer responsibilities

You must ensure the work area is reasonably safe and accessible. This includes moving fragile items, clearing access routes where possible, securing pets, and informing us of any hidden hazards such as broken paving, sharp objects, unstable structures, concealed cables, contaminated waste, or aggressive animals. You must tell us in advance about any restrictions affecting parking, vehicle access, shared access, or entry to the property.

If the service requires us to work near utility points, ponds, retained water, steep slopes, or other hazards, you must notify us before the visit. We may suspend work if we believe the area is unsafe or if the condition of the garden creates a risk to our team, your property, or third parties.

Where a service depends on your approval, cooperation, or timely access, delays caused by the absence of instructions or access may result in additional charges or rescheduling.

5. Payments

Unless agreed otherwise in writing, payment is due on completion of the work or on the date stated in the invoice. We may require a deposit for larger jobs, repeat work, materials, waste removal, or services booked at busy times. Any deposit requested will be explained before the booking is confirmed.

We accept payment methods notified at the time of booking or invoicing. You are responsible for ensuring that payment is made in full and that any bank charges, failed payments, or card processing issues are resolved promptly. If payment is not received by the due date, we may charge interest and recovery costs to the extent permitted by law.

Where a service is provided on a recurring basis, invoices may be issued after each visit, weekly, monthly, or at another agreed interval. Non-payment may result in cancellation or suspension of future visits.

6. Cancellations and rescheduling

If you need to cancel or rearrange a booking, please provide as much notice as possible. Cancellations made at short notice may involve a charge where we have already allocated labour, equipment, or materials, or where the booking cannot reasonably be filled by another customer.

If you cancel after we have started travelling to the site, arrived at the property, or begun work, you may be charged for time spent, travel, materials purchased, or a minimum call-out fee. If adverse weather, unsafe conditions, or circumstances beyond our control prevent the work from taking place, we may reschedule the appointment without liability for any indirect loss.

We may cancel or reschedule a booking if access is unavailable, if the property is unsafe, if you fail to provide important information, or if conditions prevent us from carrying out the service to a reasonable standard. In such cases, we will aim to offer an alternative date where possible.

7. Service performance and variations

We will use reasonable skill and care when providing services. Gardening outcomes can be affected by weather, plant health, soil condition, previous maintenance, seasonal factors, pest activity, and the structure of the garden itself. For this reason, some results may take time or require repeat visits to achieve the best outcome.

If you request a change to the scope of work, we may update the price and timing accordingly. Any variation agreed during the visit forms part of the contract once accepted by both sides. We are not obliged to carry out extra work that was not included in the original booking, especially where doing so would make the job unsafe, impractical, or inconsistent with the agreed service.

8. Waste handling and regulations

Where green waste removal is included or agreed as an additional service, we will handle waste in accordance with applicable UK waste laws and environmental requirements. Green waste may include grass cuttings, branches, hedge trimmings, leaves, soil, and other organic garden material. Non-green waste, hazardous materials, chemical containers, asbestos, paint, building rubble, electrical items, and contaminated items are excluded unless we specifically agree otherwise in writing and have the legal ability to remove them.

You must not ask us to remove waste that is unsafe, illegal to transport, or requires special licensing or treatment unless this has been clearly agreed in advance. If waste presented for removal differs from what was described, or if it contains prohibited items, we may refuse collection or charge extra for the additional handling, disposal, or return of materials.

Any waste transfer, disposal, or recycling will be carried out through appropriate lawful channels where required. If waste is left on the property for collection by arrangement, you are responsible for safeguarding it until removal takes place. We are not responsible for waste that is tampered with, removed by third parties, or contaminated after the visit unless this results from our negligence.

9. Liability and limitations

We will take reasonable care to avoid damage to property, plants, fixtures, and outdoor features. However, you acknowledge that gardening work can involve risks, particularly where plants are overgrown, roots are invasive, structures are aged, or surfaces are unstable. Some incidental disturbance to soil, lawn, or plant material may occur as part of normal service delivery.

We are not responsible for pre-existing damage, hidden defects, poor installation, underground services not disclosed to us, or deterioration caused by weather, pests, disease, or natural growth. We are also not liable for losses arising from inaccurate information provided by you, your failure to disclose hazards, or your failure to secure access, pets, valuables, or fragile items.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded under English law. Subject to that, our total liability for any claim arising out of a booking shall be limited to the amount paid or payable for the specific service giving rise to the claim, except where the law requires otherwise.

We are not liable for indirect, consequential, or economic losses, including loss of profit, loss of opportunity, or loss of enjoyment, whether arising in contract, tort, or otherwise.

10. Complaints and issues

If you are unhappy with any aspect of the service, you should let us know as soon as reasonably possible so that we can investigate and, where appropriate, return to inspect or resolve the issue. Complaints should include enough detail for us to identify the booking and understand the concern. We may ask for photographs or further information to help assess the matter.

We aim to deal with complaints fairly and promptly. If a defect or issue is caused by our workmanship and is capable of reasonable correction, we may offer to revisit the site, remedy the issue, or provide a partial refund at our discretion, subject to your cooperation and reasonable access.

11. Suspension of services

We may suspend or withdraw services where you fail to make payment, where access is repeatedly unavailable, where our team is exposed to unsafe conditions, or where you breach these terms. Suspension does not affect our right to recover sums due for work already carried out. We may also terminate a booking if continued performance would be unlawful, unsafe, or commercially impractical.

12. Data and privacy

We collect and use customer information only to administer quotations, bookings, service delivery, invoicing, customer support, and related operational purposes. We handle personal data in accordance with applicable UK data protection law. We will not use your information for unrelated purposes unless we are permitted or required to do so by law.

13. Changes to these terms

We may update these Terms and Conditions from time to time to reflect changes in our services, business practices, or legal obligations. The version in force at the time of your booking will apply to that booking unless a different version is expressly agreed in writing. Continued use of our services after any update will mean you accept the revised terms for future bookings.

14. Governing law

These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales. Any dispute arising in connection with these terms, the services, or any booking shall be subject to the exclusive jurisdiction of the courts of England and Wales.

By booking with Gardeners Croydon, you confirm that you have read, understood, and agreed to these Terms and Conditions.
